Delivery:
Seller will make every reasonable effort to effect shipment on or before estimated date in Seller's acknowledgment to Purchaser's Order. Seller is not liable for delays caused by government order, strikes, lockouts, floods, fires, explosions, earthquakes and other causes beyond Seller's reasonable control.

Title Risk of Loss:
Shipment of all products shall be C.I.F. customer warehouse facility. Title to, and risk of loss or damage to product shall pass to Buyer upon delivery to carrier at the point. Buyer shall have the responsibility for dealing with carrier in the event of carrier's mis-delivery, loss or damage of product.

Limitation:
Power4PC.com shall not be liable for damage or penalty as result of late or lost shipments, even if the Seller has been notified that such damages or penalties may apply.

Payment:
All goods are payable C.O.D. immediately upon receipt, unless otherwise arranged. A finance charge will be applied each month on past due accounts computed at the rate of 1.5% per month.

POWER4PC.COM WILL CHARGE A 15% RESTOCKING FEE FOR ALL PRODUCTS REFUSED.

Returns:
All returns require a "RMA" number which can be obtained by emailing our Service Center rma@power4pc.com. The Receiving department will automatically REFUSE any shipment that does not CLEARLY show and a RMA number. ALL RMA MERCHANDISE SHOULD ARRIVE AT Power4PC.com FREIGHT PREPAID. All RMA merchandise will be repaired and returned via UPS Ground/COD. Power4PC.com will pay ONE WAY shipping on returned merchandise to the dealer only. END USER MUST SEND ALL RMA MERCHANDISE TO DEALER.

*For all returns we will not refund shipping charge.
*All return must be made within 30 days of the original purchase date.
*All return merchandise must be in good condition and re-sellable in order to get full refund on the product.
*Return products that are not in good or re-sellable condition, seller will have the right to make decision on the amount of refund.

Power4PC.com will reject ALL RMA MERCHANDISE coming from end user. In the event our receiving department mishandles receiving from end user, end user is subject to a handling fee or rejection of merchandise.

Limited Warranty:
Seller warrants its products to be free from defects in materials and workmanship for a period of 1 year from the date shipment to the original buyer and that upon notice of any such defect. Seller shall, at its option, repair or replace the defective product at no cost in material and labor only.

Security Interest:
Power4PC.com reserves a security interest in all merchandise for which payment in full had not been received.

Attorney's Fee:
In the event it becomes necessary to incur collection cost or institute suit to collect any amount due under this agreement, then buyer agrees to pay such additional collection costs, charges and expenses including all the attorney's fee if the account is placed in the hands of an attorney for collection.

APPLICABLE LAW: This agreement shall be governed by and in accordance with the laws of the State of California.
